1. Acceptance of Terms

By accessing or using Calen ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Calen is an AI companion service that provides conversational companionship, practical assistance, and safety features for adults. The service operates through:

• Telegram bot (@CalenDash_life_bot)
• WhatsApp (+1 561 652 5307 via Twilio Business)
• Phone calls (+1 561 652 5307 via Twilio)

Calen features include:

• AI companion conversations with persistent memory
• Medication reminders (based on information you provide)
• Document and bill explanation
• Scam detection for forwarded suspicious messages
• Voice messages and phone call support
• Daily morning briefings (personal updates, reminders, activities)

You must be:

• At least 16 years old
• Able to enter binding contracts

Calen is designed primarily for adults aged 50 and above, but is available to any eligible adult who finds the service useful.

6. Accounts and Security

6.1 Account Creation

Your account is created when you first interact with Calen through any supported channel (Telegram, WhatsApp, or phone). Your account is identified by your messaging platform ID or phone number.

6.2 Account Termination

We may suspend or terminate accounts that:

• Violate these terms
• Attempt to manipulate or abuse the AI system
• Use the service for illegal purposes
• Attempt to access other users' data

7. Persistent Memory

A core feature of Calen is persistent memory. By using the service, you acknowledge that:

• Calen automatically extracts and stores personal information from every conversation
• This includes names, medications, appointments, preferences, family details, and more
• Memory is stored in a per-user file on our server
• You can ask Calen to "forget" specific information or delete your entire memory file
• Calen may note conversational patterns (like repeated questions) as part of attentive companionship

8. Gift Purchases

Calen may be purchased as a gift for another person. Gift-buyers agree that:

• They will never have access to conversation content, memory data, or health information
• The recipient's conversations with Calen are completely private
• Gift-buyers may be contacted when the gift period is nearing expiry, for renewal purposes only

9. Payments and Gift Model

9.1 Gift-Based Access

• Calen is accessed through a free 3-day trial or a one-time payment: $29 for 1 month, $69 for 3 months, or $119 for 6 months
• No subscriptions, no auto-renewals, no recurring charges
• When the gift period ends, the service stops
• A new gift can be purchased to extend access
• Data is retained for 90 days after the access period ends. After 90 days without renewal, all personal data is permanently deleted

9.2 What Is Included

• Unlimited conversations across all channels (Telegram, WhatsApp, phone)
• Persistent memory and full AI companion features
• Voice messages and phone call support
• Medication reminders, document explanation, scam detection
• Daily morning briefings

9.3 Payments

• Payments processed via PayPal
• One-time charge per gift purchase

9.4 Refund Policy

• Full refund within 14 days of activation for monthly and multi-month plans
• The free 3-day trial is non-refundable
• After 14 days, no refunds are available
• To request a refund, email [email protected]
• Refunds are processed via PayPal and typically arrive within a few business days
• When a refund is issued, access to Calen is revoked immediately

Calen integrates with the following third-party services:

• Anthropic (Claude): AI conversation processing (United States)
• ElevenLabs: Text-to-speech voice generation
• Groq (Whisper): Speech-to-text transcription
• Twilio: Phone call infrastructure
• PayPal: Gift payment processing
• Telegram Bot API: Telegram messaging
• WhatsApp Business API: WhatsApp messaging
• Hetzner: Server hosting (Finland)

By using Calen, you acknowledge that your data may be processed by these third parties in accordance with their respective terms of service and privacy policies.

12. Acceptable Use

You agree NOT to:

• Use the service for any illegal purpose
• Attempt to manipulate Calen into generating harmful, illegal, or inappropriate content
• Attempt to access other users' data or memory files
• Use automated scripts to interact with the service
• Create multiple accounts to circumvent service limits
• Share account access with others
• Use the service to harass or harm others
• Misrepresent Calen's advice as professional medical, legal, or financial guidance

13. Intellectual Property

Calen and its original content are the exclusive property of the service operator. You may not copy, modify, or distribute our code or content without permission. Your personal memory file and conversation data belong to you.

14. Limitation of Liability

To the maximum extent permitted by law:

• We provide the service "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to amounts paid by you in the past 12 months
• We are not responsible for third-party service failures or data loss
• We are not liable for actions taken or not taken based on Calen's responses
• Medication reminders are a convenience feature - missed or incorrect reminders do not constitute liability

15. Indemnification

You agree to indemnify and hold harmless Calen from any claims arising from:

• Your use of the service
• Your violation of these terms
• Decisions made based on Calen's responses or analysis
• Your interactions with third-party services

16. Modifications to Terms

We may update these terms. Continued use after changes constitutes acceptance. Material changes will be communicated through Calen (in your conversation) at least 30 days in advance.

17. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.
